Copyright policy

How to report a photo or video you believe infringes your copyright, and how we respond.

Sun Coast Digital Media LLC, d/b/a Listthru, respects copyright and responds to notices of claimed infringement under the Digital Millennium Copyright Act, 17 U.S.C. section 512.

Reporting infringement

If you believe content on the Service infringes your copyright, send a written notice to our designated agent that includes: 1. Your physical or electronic signature. 2. Identification of the copyrighted work you claim is infringed. 3. Identification of the material you claim is infringing, with enough information for us to locate it. 4. Your name, mailing address, telephone number and email address. 5. A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent or the law. 6. A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.

Counter-notices

If your content was removed and you believe that was a mistake or misidentification, you may send a counter-notice to our agent that includes: 1. Your physical or electronic signature. 2. Identification of the removed material and where it appeared before removal. 3. A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification. 4. Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the U.S., any district where we may be found), and that you will accept service of process from the person who filed the original notice.

We may restore the material in 10 to 14 business days unless the complaining party tells us it has filed a court action.

Repeat infringers

We terminate, in appropriate circumstances, the accounts of users who repeatedly infringe copyright.

Misrepresentation

Under 17 U.S.C. section 512(f), anyone who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages.
